In the latest turn of events, the litigation in Elon Musk’s defence in the $258 billion Dogecoin case is experiencing a reshuffle, according to the document filed in a Federal Court.
The new filing in Manhattan Federal Court showed that attorney Adam Gabor had left Musk’s team and was replaced by Allison Huebert, a former litigator and experienced lawyer at Quin Emanuel law firm.
The reshuffle happened days after the legal team leaked sensitive information regarding the case to the New York Post last week.
Attorney Gabor has been at the centre of the action of the Dogecoin class-action lawsuit for over a year now, and many would have expected him to stay until the case is heard and determined. As things stand, Gabor is leaving and has been replaced by Allison Huebert.
Musk is believed to be putting together a “hardcore litigation department” and created the department’s email address “justice@tesla.com.”
The Twitter owner confirmed this in a May 20 tweet where he said:
“Tesla is building a hardcore litigation department where we initiate and execute lawsuits directly. The team will report directly to me.”
The lawsuit and its latest developments
In a case filed on June 16, 2022, under Johnson v. Musk et al., in the Southern District of New York Federal Court, the plaintiff Keith Johnson, accused Musk of intentionally using his social media influence to drive up the price of DOGE before it crashed despite knowing that it had no significant value. The investor claimed that the scheme benefited Musk and the Dogecoin Foundation greatly.
The lawsuit further explained that Musk knew that his tweets would have impacted the price of Dogecoin and trading volume, ultimately making many people invest their money in the DOGE. The battle is still in the corridors of justice, where the plaintiff demands compensation amounting to $258 billion.
Later in September of 2022, the lawsuit expanded through a filed amendment that added seven new plaintiffs and six new defendants, including Musk’s companies, Tesla, SpaceX, Boring, and others.
Early this year, Musk’s lawyers asked the judge to throw the case out, calling the case a “fanciful work of fiction.” The lawyers led by Gabor stated that the investor never explained how the Tesla CEO intended to defraud anyone.
Gabor stated:
“There is nothing unlawful about tweeting words of support for, or funny pictures about, a legitimate cryptocurrency.”
The defendant’s lawyer responded through their lead, Evan Spencer:
“We are more confident than ever that our case will be successful.”
Meanwhile, the latest development has witnessed a reshuffle of the defence team with the introduction of another experienced litigator Huebet making Musk serious about winning this case.
It is believed that Huebet will be the leading litigator and is tasked to compile a solid fresh team to ensure they emerge victorious in the market manipulation case facing the SpaceX CEO.
