Trump Faces Truth Social Data Lawsuit – Here Is Why Markets Are Watching

President Donald Trump and several White House officials have been sued over Truth Social’s premium data service, raising questions about whether paying customers should receive faster access to presidential posts that could potentially influence financial markets.

The Intercept and Freedom of the Press Foundation filed the lawsuit Wednesday, alleging that Truth API gives subscribers preferential access to official government announcements. The defendants include Trump, White House Deputy Chief of Staff Dan Scavino, presidential executive assistant Natalie Harp and White House entities.

Truth API Attracts Trading Firms

Trump Media launched Truth API on August 1, providing faster delivery of posts from Trump and other major Truth Social accounts.

Interim CEO Kevin McGurn said the service has already secured more than 10 agreements, primarily with high-frequency trading firms paying around $60,000 to $100,000 per month.

Trump Media argues the API simply delivers already-public information “fractionally faster.” The lawsuit, however, claims the advantage matters because Trump frequently uses Truth Social for policy, personnel and other government announcements that may affect markets.

Prediction Markets Become Another Opportunity

Trump Media is also considering licensing data to prediction-market operators as another potential revenue stream.

The company hasn’t explained exactly what information would be licensed or how prediction platforms might use it. Meanwhile, Trump Media has moved away from developing its own prediction market with Crypto.com and is instead exploring marketing partnerships with prediction platforms.

The controversy had already attracted attention in Washington. Senators Elizabeth Warren and Adam Schiff previously asked the SEC to investigate whether Truth API could raise insider trading or market manipulation concerns.

Trump Media Pulls Back on Some Crypto Plans

The lawsuit arrives as Trump Media scales back parts of its cryptocurrency strategy.

The company and Crypto.com recently abandoned plans for a publicly traded CRO treasury company, while Crypto.com is no longer involved with proposed Truth.Fi ETFs.

Trump Media also reported $360.6 million in unrealized and other digital asset accounting losses during the first half of 2026. Its crypto portfolio was valued at $597.7 million as of June 30, including 9,477 BTC and 756.1 million CRO.

For now, the lawsuit puts fresh attention on how Trump Media monetizes presidential communications, particularly when faster access could potentially provide traders with an edge.
