John Ray III, the CEO tasked with restructuring FTX, has publicly opposed Sam Bankman-Fried’s legal team’s bid for a lighter sentence. In a compelling statement to Judge Lewis Kaplan, Ray underscored the enduring hardship faced by the victims of FTX’s downfall, setting the record straight on claims made by Bankman-Fried’s defense.

The Clash Over Sentencing

Bankman-Fried’s legal team previously argued for leniency in sentencing, labeling the prosecution’s 40-to-50-year recommendation as overly severe. However, Ray’s response, drawn from his firsthand experience managing FTX’s recovery, paints a starkly different picture. He rebuts the notion that FTX was solvent at the time of bankruptcy and denounces the suggestion that no financial losses occurred under Bankman-Fried’s leadership.

The Road to Recovery

Ray detailed the extensive efforts undertaken to salvage FTX from ruin, involving a comprehensive team dedicated to asset recovery and legal compliance. Despite these strides toward restitution, Ray insists that the damage inflicted by Bankman-Fried’s alleged fraud is irreparable, leaving countless individuals and entities in a worsened state than if they had never engaged with FTX.

The revelation of a mere 105 Bitcoin remaining in FTX’s reserves at Ray’s takeover, juxtaposed with customer entitlements nearing 100,000 BTC, underscores the magnitude of the discrepancy and the alleged misappropriation of funds.

The Ongoing Impact

As FTX navigates through bankruptcy proceedings, the possibility of recouping some value for creditors offers a glimmer of hope. Nevertheless, Ray emphasizes that this potential recovery does not negate the profound losses endured by those entangled in the exchange’s collapse. He firmly refutes any attempts to downplay the severity of the situation or to cast Bankman-Fried in a sympathetic light.
