US CLARITY Act Pushes Ahead – Here Is Why Customer Crypto Could Finally Get Stronger Protection

The push for comprehensive U.S. cryptocurrency regulation continues to gain momentum as Senator Cynthia Lummis urges the Senate to advance the Digital Asset Market Clarity Act of 2025, commonly known as the CLARITY Act.

Having already passed the House of Representatives, the legislation now awaits Senate consideration. Lummis summarized one of its central goals with a simple message: “Your crypto stays yours.”

The proposal is designed to address several of the industry’s biggest legal uncertainties, particularly around customer asset protection and regulatory oversight.

Stronger Protection for Customer Assets

One of the bill’s most significant provisions would require crypto platforms to keep customer digital assets legally separate from their own corporate holdings.

If a company enters bankruptcy, customer assets would not automatically become part of the firm’s bankruptcy estate, providing investors with greater legal certainty over ownership.

The legislation also introduces standardized custody requirements intended to reduce the risks associated with commingled assets and improve how digital assets are safeguarded.

Clearer Rules for the SEC and CFTC

Beyond custody protections, the CLARITY Act seeks to establish clearer regulatory boundaries between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC).

By defining which agency oversees different categories of digital assets, lawmakers hope to reduce regulatory uncertainty that has challenged both crypto companies and investors for years.

A more predictable regulatory framework could encourage innovation while giving market participants clearer compliance expectations.

Increased Focus on Fraud Prevention

The legislation also includes approximately $150 million in funding dedicated to strengthening anti-fraud efforts across the digital asset industry.

The funding would support anti-money laundering initiatives, improve investigative capabilities, and provide law enforcement agencies with additional resources to identify and disrupt fraudulent crypto operations more quickly.

The emphasis reflects a broader shift toward preventing scams before they cause widespread investor losses rather than relying solely on enforcement after the fact.

A Defining Moment for US Crypto Regulation

The CLARITY Act builds on lessons learned from several high-profile crypto failures that exposed weaknesses in customer asset protections and regulatory oversight.

If approved by the Senate, the legislation would represent one of the most comprehensive federal crypto frameworks introduced in the United States, providing clearer rules for custody, market supervision, and investor protection.

With lawmakers continuing to debate the bill, the outcome could play a significant role in shaping how digital assets are regulated in the U.S. for years to come.
